WEIGHING

Rules 217, 218, 219

 Cotton is traded on NCW Shipping weights or Landed weight NLW.

 Weighing bale by bale (if buyer requests weigh-bridge weighing instead of bale by bale weighing, then has to be confirmed with shipper )

 The weight of bales which are condemned, short-landed, burst, wrongly marked or not marked will be calculated accordingly to the average gross weight of the landed bales, as long as at least 25% of the lot has been landed in good condition. If less than 25% is in good condition, the weight of the bales will be calculated accordingly to the ave invoice weight.

 If the buyer does not weight the total shipment within 28 days (4 weeks) of the date of the arrival of the cotton, the unweighed bales will be calculated according to the ave gross weight of the weighed bales, as long as at least 90% of the lot has been weighed. If less than 90% of the lot has been weighed, the weight of the unweighed bales will be calculated according to the ave invoice weight.

SAMPLING

Performed actually or just supervising such sampling.

Outturn sampling is to learn the quality by the buyer or receiver of such samples by classing and testings

Arbitration sampling is to draw samples to possibly settle a claim in a situation of a quality arbitration. The samples represent the cargo for quality. Samples are kept by the controller and forwarded to the arbitrator when no amicable settlement of a dispute can take place.

SURVEYS

 Country damage survey

 Defines the rotten cotton occurred to excess humidity or dirt penetrating from outside of the bales to the inside of the bales. Normally occurring during storage and bales are exposed to excess moisture. 

 Foreign Matter survey

 Defines the foreign matter as plastic, ropes, foreign fibres, excess seeds in a cotton bales and the cost to remove it from the bales. 

 False Packed survey

 Defines the damage inside of the bales and the costs to remove it. This damage occurs through cheating of adding none cotton material e.g. stones, metals to increase the weight or humidify the bale excessively inside to increase the weight of the bale that the bale start rotting from inside to outside.

 Fire damage survey

 Defines the damage of the bales after a fire. Defines a possible salvage value.

COMPARISON OF ICA AND CCA CONTRACT (INSPECTION)

 CIQ 90 Time Limits Bales by bale weighing ICA 28 days, CIQ weighing in 90days.

 Location of weighing ICA rules clearly defines in their suggested contract where weighing takes place. CIQ where the cotton is finally delivered e.g port, warehouse in the country, spinning mill, possible different spinning mills.

 Bales lost during the transit are considered a loss covered by an insurance under ICA rules. CIQ lost bales are considered a weigh loss.

 Country damage is established under ICA rules and since seller is responsible he has with the certificate the possibility to claim for his insurance the loss. CIQ simply deducts the damage from the arrived net landed weight.

 Samples for quality settlements are sealed by representative of the seller and the buyer under ICA rules. CIQ no sealing of samples by a representative of the seller or the seller in the business string.
